If the estate deed or affidavit of death has recorded, he occupies, and he is 62, the file can be an ordinary origination. If the estate is still open and three siblings are still on the petition, counseling is early.

Can I originate a HECM on a house I inherited if I now occupy it?
Yes, when 24 CFR 206.33 age, 24 CFR 206.39 occupancy, and 24 CFR 206.35 title are all true. The recorded path in California may be a probate deed, a small-estate affidavit, or a spousal property order. Arizona has its own affidavit and probate paths. The recorded instrument, not a funeral program, changes vesting.

What probate or affidavit-of-death papers must record before title is insurable?
Whatever your state uses to move the deceased off title and the heir on. Title will list the gap until that happens. I will not originate on an unprobated will in a drawer.
Lender overlays may still wait after a last-minute estate deed. 24 CFR 206.36 seasons liens, not the inheritance. I will not invent a day count. Confirm that overlay with the underwriter. Counseling still costs $125–$175. The HUD certificate lasts 180 days. A California inherited-home file still waits seven days after counseling under Civil Code 1923.2(k) before a complete application. Do not start that clock while the Merced estate is open.
An inheritance does not discount the 2.00% initial MIP of claim amount under Mortgagee Letter 2017-12. An inherited-home HECM in 2026 still uses the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. An inheritance does not discount MIP.
If residual income requires a LESA, that set-aside is still origination-only. A thin tax history on a house you just inherited can still force a LESA. The LESA does not pay siblings.
When does an inherited house with siblings still on title fail 24 CFR 206.35?
When those siblings remain owners and will not sign the mortgage as non-borrowing mortgagors. 24 CFR 206.35(c) and (d) require that signature and a certification. Buying them out can be a mandatory obligation paid at closing if leftover principal limit covers it and 206.36 allows the payment. A leftover line that cannot cover three buyouts is arithmetic, not a deny of the idea.
A second geography: a 70-year-old in Flagstaff who inherited a cabin she visits twice a year. Occupancy is still 24 CFR 206.39. A vacation inheritance is not a principal residence. The estate deed does not fix that.

Heirs who later keep Isidro’s HECM house repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). Inheriting once does not rewrite that subsection for the next generation.
Isidro should ask the probate attorney for the recording date of the estate deed before he books counseling. If siblings must sign a deed-off, get those signatures while everyone is still speaking.
