How does the reverse mortgage non-recourse guarantee protect me?

HECM non-recourse protection limits the lender’s recovery to the home and FHA insurance when the loan ends, so you should not owe a personal deficiency from wages solely because sale proceeds were short. What does 24 CFR 206.27(b)(8) actually protect during my lifetime?

It tells you the HECM is not supposed to become a personal judgment machine for a collateral shortfall. You can occupy while duties are current even if the balance later exceeds value. You still pay the treasurer. You still keep hazard insurance. You still certify occupancy. Annual MIP of 0.50% of outstanding balance still accrues. Mortgagee Letter 2017-12 already charged 2.00% initial MIP of claim amount when Cora originated.

Cora’s leftover cash at origination still sat in the mid-30s to low-50s percent of appraised value, depending on age and expected rate. I will not quote a live cell. Run the Casa Grande worksheet before anyone treats non-recourse as a reason to ignore leftover-cash math. Do not interpolate HUD rows.

Counseling still costs $125–$175. The HUD certificate lasts 180 days. Arizona has no 1923.2(k) pause. Non-recourse is not a counseling substitute.

Where does non-recourse protection stop?

Fraud, occupancy fiction, and unpaid property charges. 24 CFR 206.27(c) still lists due-and-payable events. A LESA, if required, is origination-only. Jay confirmed it cannot be added later. Non-recourse does not create a LESA. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. Those origination facts are not non-recourse clauses.

Heirs who keep the house still repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). Non-recourse does not convert that subsection into a gift. If they sell, the shortfall path is the house plus FHA insurance, not a 95% slogan. They should still request a written payoff.

How should an adult child use non-recourse without turning it into a myth?

Ask whether the loan is a HECM. Ask whether occupancy is true. Ask whether taxes are current. Then ask what happens at sale versus keep. See when balance exceeds value. A child who says “Mom can never owe” is skipping the duties. A child who says “Mom will owe the whole gap from Social Security” is skipping 24 CFR 206.27(b)(8) on a HECM.

A second geography: a 70-year-old in Merced whose California HECM sits above a cooled appraisal. Same federal non-recourse rule. Same occupancy test. Civil Code 1923.2(k) is not a non-recourse tool. That statute was origination.

Who should not originate because they think non-recourse means no duties?

This path does not help a household that wanted proceeds and a cancelled tax bill. Occupancy is still 24 CFR 206.39. I work with multiple lenders. I will originate when Cora understands both the shield and the duties. I will turn away a no-tax plan whose only thesis is the word non-recourse.

If leftover cash after 2.00% of claim amount is a token, skip the loan. Non-recourse cannot invent a reason to pay MIP. It can keep a later shortfall from becoming a personal wage garnishment story when HUD’s rules apply. That is the protection. That is also the limit.

Does non-recourse protect a non-borrowing spouse the same way?

HUD’s non-borrowing-spouse framework is a different set of rules from 24 CFR 206.27(b)(8). Cora should not mix them. Merced files with an NBS still have occupancy and counseling facts. Non-recourse limits deficiency at the end of a HECM. It does not automatically keep a non-borrowing spouse in the house without those NBS tests. Confirm the file. Do not import a slogan.

If I sell for less than the balance, who handles the shortfall paperwork?

The servicer, then FHA insurance rules on a HECM. Cora should not mail a personal check for a gap HUD’s non-recourse path is supposed to cover.
