Can I get a reverse mortgage if my property taxes are deferred?

A property-tax deferral usually stops reverse mortgage eligibility until that deferral lien is paid or validly subordinated. Jay Zayer, CRMP, is a reverse mortgage specialist at reversemortgage.coach. 24 CFR 206.27(b)(3) is blunt: the borrower shall not participate in a real estate tax deferral program or permit liens against the property unless those liens are subordinate to the insured mortgage. A senior postponement program is not a hidden HUD feature.

Here’s how this plays out: Florian, 78, in Sacramento, used California’s Property Tax Postponement and now wants a HECM to drop a remaining coupon. The Controller’s lien is a recorded charge. Title will not ignore it. Paying that postponement at closing can be a mandatory obligation if leftover principal limit covers it. Staying in the deferral ahead of a new first lien is the fail.

A HECM remains FHA-insured. Tax postponement is a state program. It is not a government HECM benefit.

Does 24 CFR 206.27(b)(3) allow me to keep the deferral after funding?

Only if the deferral lien is subordinate to the insured mortgage. Most senior postponement liens will not subordinate to a new HECM. Then the path is payoff at closing, or no origination. I will not originate a file whose plan is to keep the Controller ahead of FHA.

Leftover cash after the postponement payoff still models in the mid-30s to low-50s of value after age and expected rate. I will not quote a live cell. Run the worksheet with the Controller demand, not without it.

How is a California postponement lien paid on a HECM file?

As a recorded payoff. Title will list it. The demand comes from the State Controller’s office, not from a kitchen-table estimate. 24 CFR 206.36 can still limit paying an unseasoned non-HECM lien from HECM proceeds unless the lien is older than twelve months or cash to the borrower is $500 or less. A long-running postponement is usually seasoned. Confirm the date with title. I will not invent a Controller overlay.

Mortgagee Letter 2017-12 still charges 2.00% initial MIP of claim amount even after the postponement is cleared. Annual MIP is 0.50% of outstanding balance. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. Paying a deferral does not discount MIP.

If residual income requires a LESA, that tax-and-insurance set-aside is still origination-only. Leaving postponement does not let servicing add a LESA later. The LESA, if written, holds estimated future taxes. It is not a new state deferral.

Counseling still costs $125–$175. The HUD certificate lasts 180 days. California Civil Code 1923.2(k) still adds seven days after counseling on Florian’s Sacramento file. Do not start that clock before the Controller demand is real.

What if my Arizona taxes were also “deferred” by a county program?

Some counties run senior deferral or assistance that still creates a lien. 24 CFR 206.27(b)(3) is federal. I will not invent an Arizona program name or a dollar cap. The prelim decides whether a lien exists. If it does, it must be subordinate or paid.

A second geography: a 82-year-old in Tucson whose “deferral” was only a late-installment plan with the treasurer, not a recorded postponement. That is a payoff or a residual-income item, not 206.27(b)(3). The recorded instrument, not the household’s word “deferred,” decides.

An adjustable HECM after a postponement payoff still accrues at 1-month CMT plus lender margin. Expected rate still rounds to 0.125% under 24 CFR 206.3.

Jay still quotes about 30 days on a complete refinance after the Controller demand is in the file, not while the postponement is unquoted.

Who should not treat postponement as extra HECM capacity?

This path does not help a household that wants to stack a HECM and keep the state paying taxes in first position. I will not. It does not help a household whose leftover principal limit cannot cover the Controller demand and who still wants a large cash-out. Pay from other funds, or do not originate.

Heirs who later keep Florian’s house repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). A paid postponement does not rewrite that subsection.

I work with multiple lenders. I will originate after the deferral lien is cleared or validly subordinated. I will turn away a postponement file whose plan is to stay ahead of FHA.

Does paying the Controller demand count as a 24 CFR 206.36 unseasoned lien?

Only if the postponement lien has sat on title less than twelve months and leftover cash to Florian would exceed $500. A long-running California Property Tax Postponement is usually seasoned. Confirm the recorded date with title. I will not invent a Controller overlay or a payoff-form number. 24 CFR 206.27(b)(3) is still the reason the lien cannot stay senior. 206.36 is only the proceeds-source rule after you decide to pay it.

Tucson “deferral” that is only a late-installment plan with the treasurer is not 206.27(b)(3) unless a lien actually recorded. Words households use for “I have not paid yet” are not the recorded instrument. Title is.

Leaving postponement does not create a LESA in servicing later. If residual income requires a tax-and-insurance set-aside, it is written at origination only. The LESA holds estimated future installments. It is not a new state postponement program wearing FHA clothes.

Does HUD let a HECM close while I stay in a senior property-tax deferral program?

Not if the deferral keeps an unsubordinated lien ahead of the HECM. 24 CFR 206.27(b)(3) says the borrower shall not participate in a real estate tax deferral program or permit liens against the property unless those liens are subordinate to the insured mortgage.

Must California Property Tax Postponement be paid off at a HECM closing?

Typically yes, because the Controller's postponement lien will not sit junior to a new first-lien HECM. Pay it as a mandatory obligation, or do not originate. This page will not invent a Controller payoff-form number.

Can a LESA replace the deferral so I never pay taxes again?

A LESA may hold estimated taxes at origination. It is not a state postponement program. You leave the deferral. The LESA, if required, is set only at origination and cannot be added later.
