Can a conservator sign a HECM the way they sign a forward mortgage?

What occupancy and counseling facts still have to be true?
Kit must occupy as a principal residence. A conservator who lives in Phoenix cannot occupy the Tucson house by caption. 24 CFR 206.27 can still accelerate if occupancy fails. Counseling still costs $125–$175. The certificate lasts 180 days. Arizona has no California Civil Code 1923.2(k) seven-day pause, but counseling is still federal. Do not burn that certificate on a channel that will not take conservatorship files.
Mortgagee Letter 2017-12 still charges 2.00% initial MIP of claim amount if a conservatorship HECM closes. Annual MIP is 0.50% of outstanding balance. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. A court caption does not discount MIP.
If residual income requires a LESA, that set-aside is still origination-only. A conservator cannot add one later in servicing.
How is a conservator different from an agent under a power of attorney?
A conservator is court-appointed and court-supervised. A POA is a private instrument. Lenders treat them as different exhibits. A POA often still expects the borrower to participate in counseling. A conservatorship may limit the conservatee’s ability to participate. That tension is why many files stall. I will not paper over it.

Heirs who later keep a house that actually closed repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). A conservator’s signature does not rewrite that subsection.
