A power of attorney does not, by itself, deny reverse mortgage eligibility, and it does not let an agent originate a Home Equity Conversion Mortgage while the homeowner is a missing person. A POA is a signing tool. It is not a substitute occupant.
Picture a homeowner who is Liora, 77, in Palm Desert, who recorded a durable POA naming her son after a hospital stay and now wants a HECM. If Liora occupies, can participate in counseling, and the POA is in a form the channel will take, the file can proceed. If the plan is that the son applies while Liora remains in a facility and never returns, that is an occupancy file, not a POA file.
A HECM remains FHA-insured. A POA is not a government signature waiver.
Does having a POA already recorded help or hurt a HECM application?
It helps when the lender needs an agent to sign at the table and the instrument actually grants real-property and loan authority. It hurts when the family treats the POA as permission to skip Liora. 24 CFR 206.41 still requires counseling. I will not invent the counselor’s representative-counseling checklist. What does the POA have to say before title will use it?
It has to be durable if the principal may lack capacity later, it has to grant authority to mortgage homestead property, and it has to be recordable in the property county. A hospital POA for medical decisions is not a deed-of-trust POA. Title will not stretch it.
Mortgagee Letter 2017-12 still charges 2.00% initial MIP of claim amount on a POA-signed HECM. Annual MIP is 0.50% of outstanding balance. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. A POA does not discount MIP.
If residual income requires a LESA, that set-aside is still origination-only. An agent cannot add one later.
Counseling still costs $125–$175. The HUD certificate lasts 180 days. California Civil Code 1923.2(k) still adds seven days after counseling on Liora’s Palm Desert file. Do not start that clock on a medical POA.
How is a POA application different from the son simply being on title?
If the son is on title, 24 CFR 206.35 may require him to sign as a non-borrowing owner. If he is only an agent, he is not an owner. Adding him to title “to make the POA easier” can create the joint-ownership problem. See add name to title and joint ownership.
A second geography: a 72-year-old in Yuma whose Arizona POA uses different statutory language than California’s. HUD’s borrower tests are federal. State POA statutes still have to make the mortgage valid. The underwriter’s exhibit list, not a stationery-store form, decides.
An adjustable HECM signed with an accepted POA still accrues at 1-month CMT plus lender margin. Expected rate still rounds to 0.125% under 24 CFR 206.3.
Jay still quotes about 30 days on a complete refinance when the POA is already accepted, not while a medical form is the only paper.
Who should not use a POA so the homeowner can skip counseling?
This path does not help a household that wants the son to counsel and sign while Liora is unaware. I will not. It does not help a household whose principal already lives in a facility as the real home. See part-time assisted living.
Heirs who later keep Liora’s house repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). A POA at origination does not rewrite that subsection.
I work with multiple lenders. I will originate when the borrower occupies and the POA is a real signing tool. I will turn away an agent-only file whose principal is missing from the house.
Can two agents under one POA both sign the HECM note?
Only if the instrument actually authorizes co-agents to mortgage, and the title company and wholesale channel will take that structure. A stationery-store form that names two children “just in case” is how Palm Desert files stall. Liora still has to occupy and still has to complete HUD-approved counseling in a form the agency will accept. The POA is a signing tool. It is not a second borrower.
