HUD does not print a homestead deny in 24 CFR Part 206. A California homeowner’s exemption is usually an assessor filing that lowers the taxable value of your principal residence. An Arizona homestead is creditor protection. Neither one is a HUD product bar. Occupancy under 24 CFR 206.39 still has to be true. Title under 24 CFR 206.35 still has to support a first lien.
Imagine a couple who are Gareth, 70, and his spouse in Tucson, occupying a paid-off house with Arizona homestead protection on the tax roll and a recorded declaration. That paper does not stop a HECM. A seminar speaker who said “homestead means HUD cannot lien the house” invented a bar. Title will still insure a first-lien deed of trust when the exception is ordinary.
A HECM remains FHA-insured. A homestead filing is not a government equity shield against the mortgage you asked for.
Does a homestead exemption make the house HECM-ineligible?
No. Eligibility is age, occupancy, property, and insurable title. The exemption is a tax or creditor-protection fact. It is not 24 CFR 206.45. How is a California homeowner’s exemption different from an Arizona homestead?
California’s homeowner’s exemption is typically filed with the county assessor on a principal residence. It can change the tax bill. It does not rewrite HUD occupancy. Arizona’s homestead statute protects equity from many creditors up to a state cap. It does not block a voluntary first-lien HECM Gareth asked to record. Confirm unusual recorded declarations with title. I will not invent a HUD homestead-form exhibit.
Mortgagee Letter 2017-12 still charges 2.00% initial MIP of claim amount on a homesteaded HECM. Annual MIP is 0.50% of outstanding balance. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. An exemption does not discount MIP.
If residual income requires a LESA, that set-aside is still origination-only. A homestead filing does not create a LESA, and a LESA does not replace taxes.
Counseling still costs $125–$175. The HUD certificate lasts 180 days. Arizona Tucson has no California Civil Code 1923.2(k) seven-day pause. A Sacramento homeowner’s-exemption file still has that pause. The homestead paper does not.
Does recording a homestead declaration change first-lien title?
Ordinary declarations usually show as a standard exception. A declaration that tries to bar all mortgages is a title fight. Payoff of other liens still follows 24 CFR 206.25 mandatory obligations. See judgment lien if a creditor recorded. Homestead is not a judgment.
A second geography: a 76-year-old in Fresno whose California homeowner’s exemption is on the tax bill and whose cousin said HUD “cannot touch homestead property.” The cousin is wrong. A voluntary HECM is a mortgage the owner asked for. Title still has to sit with the borrowers who will sign, per 24 CFR 206.35.
An adjustable HECM on a homesteaded house still accrues at 1-month CMT plus lender margin. Expected rate still rounds to 0.125% under 24 CFR 206.3. Jay still quotes about 30 days on a complete refinance after title is ordinary, not while a homemade “homestead bar” is on the prelim.
Heirs who later keep Gareth’s house repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). A homestead filing does not rewrite that subsection into a family discount.
Who should not treat homestead as extra HECM capacity?
This path does not help a household that wants to stack a HECM and keep a senior postponement in first position. I will not. Occupancy is still 24 CFR 206.39. I work with multiple lenders. I will originate when homestead is an ordinary exemption and title is insurable. I will turn away a homemade bar whose only thesis is that HUD cannot lien a principal residence the owner asked to mortgage.
Does a homestead filing change residual income or the tax bill HUD looks at?
A California homeowner’s exemption can change the tax installment used in residual income. An Arizona homestead usually does not. Gareth’s Tucson declaration is creditor protection. It is not extra principal limit. Fresno cousins who say HUD cannot lien homestead property are wrong about a voluntary HECM. 24 CFR 206.27(b)(3) is still the reason a senior tax postponement cannot stay ahead of FHA. Homestead is not postponement.
