Selling a home with an active reverse mortgage makes the loan due because conveyance is a 24 CFR 206.27(c) event. Jay Zayer, CRMP, is a reverse mortgage specialist at reversemortgage.coach. Escrow (or the closing attorney in states that use one) orders a payoff, wires the servicer, and hands you whatever equity remains after costs. You do not “transfer the HECM” to the buyer.
Farid, 75, occupies a house in Hanford, California and accepted an offer. He asked whether the buyer could “take over the reverse.” The buyer cannot. HUD does not assume a HECM onto a 48-year-old purchaser. See selling with a reverse mortgage for fit questions. Stay here for what the living-borrower sale actually does to the note.
A HECM is FHA-insured. A grant deed is not a servicing transfer.
What does escrow actually need from the servicer to close a living borrower’s sale?
A written payoff with a good-through date and a per-diem. Interest plus 0.50 percent annual MIP still accrue until funds post (HUD Mortgagee Letter 2017-12). Last year’s 24 CFR 206.207 statement is close. It is not the figure an escrow officer can use. Request it early. Accrual on an adjustable HECM still follows 1-month CMT plus lender margin.
Farid’s unused line, if he had one, stops being his line when the house conveys. Unused capacity is not a check he cashes at the title company unless he drew it before closing under the existing plan. Origination proceeds years ago landed in the mid-30s to low-50s of then-value, by age and expected rate. That history does not price today’s payoff. Leave the origination worksheet out of the escrow file.
Demand statements for any first-lien HECM must name the mortgagee correctly. A stale clause is how a payoff sits unapplied.
What if the offer is less than the HECM balance while I still live here?
Then you are not in the heir 95 percent sale subsection yet, because the loan is not due from death. You are a living seller who cannot close unless the payoff is covered — from the price, from your other funds, or from a renegotiated price. 24 CFR 206.125(a)(2)(ii) is a due-and-payable sale tool. Do not assume it applies to a healthy occupancy file just because the offer is thin.
A second geography: a 66-year-old in Bullhead City, Arizona who wanted to sell to a son below market and “let HUD eat it.” A below-market family sale is still a conveyance. The servicer still wants the payoff unless HUD’s due process actually applies. Identity-of-interest overlays on a later HECM for Purchase are a different statute (24 CFR 206.44). This page is the current loan getting paid.
Jay confirmed a LESA cannot be rewritten at sale as a seller credit. Unused LESA funds are a servicing reconciliation. Ask the shop how they apply. Do not invent a line on the Closing Disclosure.
Upfront MIP of 2.00 percent of claim amount was already collected. It does not come back as a sales rebate. The 24 CFR 206.31 origination cap, once charged, is not a sales rebate either.
Do California’s seven days or the three-day rescission apply to this sale?
Civil Code 1923.2(k) was the origination pause after counseling. It does not sit on a later sale of the same house. The federal three-day right of rescission applied to the HECM refinance closing, not to this grant deed. Arizona sellers never had 1923.2(k) and still pay the HECM off through escrow.
Counseling at origination cost $125–$175. The certificate lasted 180 days. Neither paper is a listing agreement. See payoff statement request for how to order the quote.
The 2026 claim cap of $1,249,125 (HUD Mortgagee Letter 2025-22) does not cap how large a payoff can grow. Accrual does that.
If Farid later buys another principal residence with a HECM for Purchase, that is a new 24 CFR 206.44 file. This sale still has to pay the old loan first.
What if I rescind a HECM refinance and then sell the house anyway?
Rescission under TILA unwinds that refinance if you are still inside the three business days after signing. A later sale of a house that already has a living HECM is just a payoff. Do not mix the clocks. California Civil Code 1923.2(k) was the origination pause. It does not sit on a listing.
Farid can list during a HECM application, but occupancy and intent still have to be true. A house already in escrow as a sale is a different conversation from originating. See home listed for sale if that is the actual fact pattern. This page assumes a living HECM already exists.
Counseling cost $125–$175. The certificate lasts 180 days. Selling does not require a new one. The 2026 claim cap of $1,249,125 (HUD Mortgagee Letter 2025-22) does not set the list price. The servicer’s dated quote plus sale costs do.
Who should not tell a buyer the HECM “transfers”?
This path does not help a household that advertises an assumable reverse mortgage. I work with multiple lenders. None of them assume a HECM onto a buyer as a continuing reverse.
It does not help someone who spends the unused line the week of closing and then wonders why the payoff jumped. Draws raise the balance. Tell escrow.
Heirs are not this page. If Farid dies before recording, 24 CFR 206.125 takes over. While he lives and sells, he repays through escrow. Leftover sale cash after the dated quote is his. The outstanding balance is the servicer’s. Wire both correctly.
