Can I get a reverse mortgage if I am a non-citizen?

Non-citizenship does not automatically deny reverse mortgage eligibility, and it often stops a Home Equity Conversion Mortgage until identity and lawful-residency overlays actually work. Take a Phoenix homeowner named Percy, 70, who occupies a paid-off house and is not a U.S. citizen. If he is a lawful permanent resident, that is the permanent resident page. If he has no lawful status, I will not originate a HECM. If he holds another work-authorized status, the channel’s overlay decides. I will not fake that overlay as Part 206.

A HECM remains FHA-insured. Immigration status is not a government HECM benefit.

Does lacking citizenship by itself fail 24 CFR Part 206?

Part 206 does not print a one-line “citizens only” sentence in the sections this site cites for age, occupancy, and title. FHA identity rules still sit on the file. I will not originate on a kitchen-table theory that “HUD does not care.” The underwriter cares. Send the identity packet there.

Mortgagee Letter 2017-12 still charges 2.00% initial MIP of claim amount if a non-citizen HECM closes. Annual MIP is 0.50% of outstanding balance. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. A visa type does not discount MIP.

If residual income requires a LESA, that set-aside is still origination-only. A LESA does not cure identity.

Counseling still costs $125–$175. The HUD certificate lasts 180 days. Arizona Phoenix has no California Civil Code 1923.2(k) seven-day pause. Do not spend 180 days on a channel that will not take the status.

How is this different from a non-English-speaker file?

A second geography: a 66-year-old in Anaheim whose California household mixes a citizen spouse and a non-citizen occupant. Title under 24 CFR 206.35 still has to match who must sign. Occupancy still has to be the borrower’s. Civil Code 1923.2(k) still adds seven days after counseling there.

An adjustable HECM after identity is accepted still accrues at 1-month CMT plus lender margin. Expected rate still rounds to 0.125% under 24 CFR 206.3. Jay still quotes about 30 days on a complete refinance when identity is already accepted, not while a visa packet is incomplete.

Heirs who later keep Percy’s Phoenix house repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). Citizenship of the heirs is a later title question. It does not rewrite that subsection at origination.

Who should not originate on an undocumented occupancy story?

This path does not help a household that wants me to skip identity because occupancy is true. I will not. Occupancy is still 24 CFR 206.39. I work with multiple lenders. I will originate when identity and residency overlays are real. I will turn away a status-unknown file whose only plan is the deed.

Can a citizen spouse occupy for a non-citizen who lives in the house too?

No. Each borrower occupies. Percy’s Phoenix occupancy is his. Anaheim mixed households still have to match title, note, and occupancy. A citizen spouse does not borrow for someone the channel will not identify. Green cards belong on the permanent-resident page. No status is a stop. Other work-authorized statuses are overlay. Confirm the live list with the underwriter before the $125–$175 counseling fee.

Does an ITIN replace a lawful-residency exhibit?

No. An Individual Taxpayer Identification Number is a tax identifier. It is not a substitute for the identity and lawful-residency packet wholesale channels actually underwrite.
