Can I get a reverse mortgage on a home with a private road?

Here’s a case that shows this: Orla, 67, occupies a paid-off house in Payson, Arizona, reached by a recorded easement across two lots with a shared-maintenance covenant. Title can often insure that. A handshake “we all use the lane” without a recorded instrument is the fail.

A HECM remains FHA-insured. A private lane is not a government road program.

Does a private road by itself make the house HECM-ineligible?

No. The prelim has to show a legal right of access. 24 CFR 206.35 still requires mortgagors to hold the property that will secure the loan. Access that can be cut off at a neighbor’s gate is not that property in a form I will originate.

When does a maintenance agreement become a HECM problem?

When unpaid road dues create a lien, when the covenant lets a neighbor block the gate, or when the appraiser cannot reach the house as a marketable dwelling. Road dues are not a LESA item. 24 CFR 206.205 still leaves association-like charges on you. Residual income has to carry them.

Mortgagee Letter 2017-12 still charges 2.00% initial MIP of claim amount on a private-road HECM. Annual MIP is 0.50% of outstanding balance. 2026 files still use the $1,249,125 cap in Mortgagee Letter 2025-22. Origination is still capped at $6,000 under 24 CFR 206.31. Gravel does not discount MIP.

If residual income requires a LESA, that set-aside is still origination-only. It does not grade the lane.

Counseling still costs $125–$175. The HUD certificate lasts 180 days. Arizona Payson has no California Civil Code 1923.2(k) seven-day pause, but access is still a title fact. Do not start the 180-day clock on a handshake driveway.

How should an appraiser treat a rough private lane?

As access and marketability. A seasonal wash-out can be a 24 CFR 206.47 item if the house cannot be reached. Cosmetic dust is not. The report, not a speech about “mountain living,” decides.

A second geography: a 80-year-old in Idyllwild whose California private road is a recorded easement with unpaid assessments. Same HUD access test as Payson. The recorded covenant, not the pine trees, decides whether dues are a lien.

An adjustable private-road HECM still accrues at 1-month CMT plus lender margin. Expected rate still rounds to 0.125% under 24 CFR 206.3.

Jay still quotes about 30 days on a complete refinance after access is insurable, not while a neighbor will not sign an easement.

Who should not originate on a driveway that exists only by courtesy?

This path does not help a household that wants me to close before the easement records. I will not. It does not help a household whose only access is a license revocable at will.

Heirs who later keep a private-road HECM house repay the outstanding loan balance under 24 CFR 206.125(a)(2)(i). A gravel lane does not rewrite that subsection.

I work with multiple lenders. I will originate when recorded access is real. I will turn away a courtesy driveway whose neighbor can close the gate.

What if the private road is recorded but the HOA gate is locked?

Then access in practice has to match access on paper. A recorded easement that a gatekeeper can refuse is a marketability and occupancy problem even when Schedule B looks clean. Orla’s Payson file needs a legal way in that a buyer, an appraiser, and a fire truck can actually use. Idyllwild unpaid assessments that have become liens are a different stop: pay or subordinate.

Who maintains a private road after a HECM closes?

You do, with the other users of the easement. HUD does not pave Payson lanes. Servicing will not grade Idyllwild switchbacks because a HECM exists. If the covenant already assigns shares, those shares stay on residual income. If a later unpaid assessment becomes a lien, 24 CFR 206.27 can still treat unpaid property charges as a default path. A HECM is not a road district.

Snow, washouts, and locked gates after closing are occupancy and access facts, not a new HUD product. Keep the recorded easement usable. If the neighbor later tries to revoke a license that was never an easement, that file should not have closed. Orla’s recorded covenant is the paper that has to survive winter.

Does a private road automatically fail HECM access requirements?
